This document outlines the terms and conditions for talents and employers using the Khebrati platform. It includes eligibility criteria, policies on assessments, scoring, data protection, and rights and obligations related to certification.

- Acceptable Use Policy: Outlines permissible and prohibited activities on the platform to ensure compliance and maintain integrity.

This document and its contents are intended solely for the use of Khebrati platform users. Unauthorized distribution, reproduction, or disclosure is prohibited.
1. Acceptance of Terms and Conditions
- Agreement Overview: By accessing Khebrati's platform, talents and employers agree to comply with these terms and conditions.
- Modification of Terms: Khebrati reserves the right to update these terms at any time. Significant changes could be communicated via email and must be shared on the platform. Continued use of the platform following changes constitutes acceptance of the updated terms.
2. Talents Terms and Conditions
• Eligibility
Talents must meet the professional experience prerequisites specified by Khebrati for each assessment level. These prerequisites may include relevant years of experience, specific technical skills, or educational qualifications necessary to meaningfully participate in the assessments.
• Registration and Account Security
- Talents are required to provide accurate and complete information upon registration. Misrepresentation may result in disqualification and account termination.
- Responsibility for maintaining account security, including passwords and login details, lies solely with the talent.
• Assessment Policy
- Format and Conduct: Exams may include multiple-choice questions, recorded interviews, and live virtual interviews. Talents are expected to participate professionally and adhere to assessment rules.
- Remote Exam Integrity: Talents must adhere to specific requirements for remote assessments, including webcam and microphone use, and must refrain from seeking unauthorized help during exams (Remote Assessment Policy).
- Prohibited Conduct: Cheating, collusion, or the use of unauthorized materials is strictly forbidden. Violations will result in immediate disqualification.
- Retakes and Attempts: Talents may only attempt each level of assessment as specified. Retakes are permitted after 30 days.
- Assessment Completion Requirement: Once a talent begins the assessment process, they are required to complete all components, including Behavioral, Logical Skills, and Technical assessments. Partial completion is not permitted, and all sections must be completed for the assessment to be valid.
- Interview Rescheduling Policy:Interviews cannot be rescheduled within 24 hours of the scheduled time. Talents must provide at least 24 hours' notice to request a reschedule. Failure to do so may result in forfeiting the interview opportunity without a refund.
- Re-assessment Policy: Talents are permitted an unlimited number of re-assessments; however, a minimum interval of 30 days is required between each re-assessment attempt. This interval ensures adequate preparation time for talents seeking to improve their scores.
- Interview Scheduling Requirement:The interview must be scheduled within 30 days of the initial assessment date. Failure to schedule within this timeframe may result in the cancellation of the assessment process and forfeiture of the assessment fee.
• Certification and Scoring
- Certification Validity: Khebrati certificates are issued without an expiration date. However, the validity of the certification may be subject to review or updates if there are significant changes in industry standards or best practices..
- Scoring: Scores are automatically calculated for all multiple-choice questions across Behavioral, Logical Skills, and technical assessments. Recorded responses from the oneway interview are validated and scored by a designated technical SME’s, ensuring a comprehensive evaluation of both objective and subjective components. Final Score is going to be shared with talents within 5 working days after technical interview completion.
- Results Timeline: To update their certification status or demonstrate improved skills, talents may opt for a re-assessment.
• Data Privacy and Usage
- Khebrati collects necessary information, including personal data, for assessment purposes. Data is handled per Khebrati’s Privacy Policy and applicable data protection regulations.
- Talents have rights to access, modify, or delete personal data, but must acknowledge that certain data is required for assessment verification purposes.
• Refund and Cancellation Policy
- Cancellations made within 24 hours of before the first assessment may qualify for a refund, less a processing fee which is 10% of the total paid amount.
- Refunds are not provided for missed exams or disqualified attempts due to misconduct.
- No refunds will be issued for any instances of misconduct during the assessment. Talents are expected to adhere strictly to the assessment instructions; failure to comply may result in disqualification without a refund. Please refer to the Assessment Instructions for detailed guidelines on acceptable conduct.
3. Employer Terms and Conditions
• Account Registration and Responsibilities
- Employers are required to register an organizational account. Verification may be requested to confirm the employer's legitimacy.
- Employers are responsible for maintaining confidentiality of account details and limiting access to authorized personnel only.
• Subscription and Access Plans
- Plan Tiers and Features: Khebrati offers tiered subscription plans tailored to varying access levels to talent profiles and support features.
- Payment Terms: Payment for subscriptions is due upon account activation, with renewals occurring automatically unless canceled prior to the renewal date.
- Billing and Invoice Policy: Khebrati provides invoices per payment cycle and supports multiple payment methods for employer convenience.
• Access to Talent Profiles and Data Use
- Employers may only access and view talents profiles for hiring or consulting purposes. Data export or unauthorized distribution is prohibited.
- Employers agree not to contact talents directly outside of Khebrati’s messaging interface, ensuring professional boundaries and respecting talent privacy.
• Refund Policy
- Employers may cancel their subscription at any time, therefore refunds are issued only as Khebrati wallet credit. Refunds for partially used subscriptions are not provided.
4. Confidentiality and Intellectual Property
- Ownership of Content: Khebrati owns all intellectual property rights to its assessment materials, certification marks, platform content, and branding.
- Talent and Employer Obligations: Talents and employers are prohibited from copying, distributing, or publicly displaying Khebrati’s materials.
- Non-Disclosure of Assessment Content: Talents and employers agree not to disclose or discuss specific assessment questions or test materials with any third parties.
5. Data Protection and Privacy
- Data Collection: Khebrati may collects personal information, browsing data, and assessment results to provide requested services by talents or employers.
- Data Usage: User data is processed to generate assessments, issue certifications, and facilitate employer-talent matches.
- Retention and Deletion: Khebrati retains data only as long as necessary for certification validation and regulatory compliance. Users may request data deletion as specified in the Privacy Policy.
- Data Security: Khebrati uses encryption and secure data storage to protect user data. Despite these measures, users acknowledge that no system is completely secure and that Khebrati is not liable for unauthorized access beyond its control.
6. Limitation of Liability
- No Guarantee of Employment: Khebrati provides assessments and certifications but does not guarantee employment or specific career outcomes.
- Platform Availability: Khebrati strives for continuous platform availability but may experience interruptions due to maintenance or unforeseen issues. Users accept these limitations and agree to hold Khebrati harmless for such interruptions.
- Exclusion of Certain Damages: To the maximum extent permitted by law, Khebrati will not be liable for any indirect, incidental, or consequential damages arising from platform use, assessment results, or employment decisions based on Khebrati scores.
7. Dispute Resolution and Governing Law
- Jurisdiction: All disputes arising from this agreement will be governed by the laws of Dubai, UAE, without regard to conflict of laws provisions.
- Arbitration: Users agree to settle disputes through binding arbitration in Dubai, UAE, before a neutral arbitrator, waiving the right to a jury trial.
8. Termination of Accounts
- Termination for Cause: Khebrati reserves the right to suspend or terminate talent or employer accounts for violations of these terms, misconduct, or if the account is deemed inactive for an extended period.
- Consequences of Termination: Upon termination, users will lose access to platform services and may not re-register without written consent from Khebrati.
9. Additional Policies
- Code of Conduct: All users are expected to interact professionally and respectfully with Khebrati staff and other users. Abusive behavior may lead to suspension or termination.
- Feedback and Suggestions: Khebrati welcomes user feedback but retains all rights to implement suggestions without owing compensation.
